高雄強冠「黑心餿水油」毒害全台，高等法院高雄分院將董事長葉文祥判刑22年，其中5年可易科罰金，並於去年駁回上訴定讞。在獄中服刑的葉文祥主張油品出包可能是「運輸上的汙染」，附理由聲請再審及停止刑罰執行。最高法院20日認為葉所提理由無法動搖原判事實，駁回再審確定。

葉文祥等人明知所販售的原料油品，為來源不明的動物混合油，及不可供人食用的飼料油，但仍以每公斤26元到30元購買，並精煉、標示為僅含豬油的「全統香豬油」進行銷售，自2015年起販售給全台285家廠商，毒害全台，不法獲利達8150萬元。

高等法院高雄分院依食安法及加重詐欺罪等285罪，重判葉文祥22年有期徒刑，其中5年可易科罰金，另外強冠未扣案的8150萬元也將依「沒收新制」沒收，強冠公司則被處以1.2億元罰金，106年9月維持二審判決定讞。

葉文祥於去年9月入監服刑後，依舊主張可能是「運輸中的汙染」等問題，才導致當時被驗出豬油油品有豬以外的動物性成分，期間再次向高分院聲請再審與停止執行遭裁定駁回，進而向最高法院提起抗告。

最高法院認為，葉文祥沒有提出足以推翻原確定判決的新事實或證據，且未具體指出高分院的駁回裁定有什麼違法不當的地方，不足以動搖原判決結果，因此維持二審認定，駁回確定。
